SUBSTITUTED TRUSTEE'S NOTICE OF SALE
 
WHEREAS, on November 12, 2010, Quitman L. Bain, III, a married man and Jennifer N. Bain, his wife executed a certain deed of trust to L. Scott Pickle, Trustee for the benefit of Mortgage Electronic Registration Systems, Inc., as nominee for Merchants & Farmers Bank, its successors and assigns which deed of trust is of record in the office of the Chancery Clerk of Attala County, State of Mississippi in Book 932 at Page 561; and
 
WHEREAS, said Deed of Trust was subsequently assigned to JPMorgan Chase Bank, National Association by instrument dated April 2, 2015 and recorded in Book 1034 at Page 559 of the aforesaid Chancery Clerk's office; and
 
WHEREAS, JPMorgan Chase Bank, National Association has heretofore substituted Shapiro & Massey, LLC as Trustee by instrument dated July 9, 2015 and recorded in the aforesaid Chancery Clerk's Office in Book 1044 at Page 011; and
 
WHEREAS, default having been made in the terms and conditions of said deed of trust and the entire debt secured thereby having been declared to be due and payable in accordance with the terms of said deed of trust, JPMorgan Chase Bank, National Association, the legal holder of said indebtedness, having requested the undersigned Substituted Trustee to execute the trust and sell said land and property in accordance with the terms of said deed of trust and for the purpose of raising the sums due thereunder, together with attorney's fees, trustee's fees and expense of sale.
 
NOW, THEREFORE, I, Shapiro & Massey, LLC, Substituted Trustee in said deed of trust, will on September 15, 2016 offer for sale at public outcry and sell within legal hours (being between the hours of 11:00 a.m. and 4:00 p.m.), at the South Door of the County Courthouse of Attala County, located at Kosciusko, Mississippi, to the highest and best bidder for cash the following described property situated in Attala County, State of Mississippi, to-wit:

From this point of beginning run South along the Western boundary line of street a distance of 150 feet; thence West 475 feet; thence North 150 feet; thence East 455 feet to the point of beginning. This lot or parcel of land is located in the NW 1/4 of the NE 1/4 of Section 29, Township 14 North, Range 7 East, Attala County, Mississippi.

WHEREAS, on August 4, 2003, Wesley David Rule and Sherri Fay Rule, executed a certain deed of trust to Debera Bridges, Trustee for the benefit of Citicorp Trust Bank, FSB which deed of trust is of record in the office of the Chancery Clerk of Attala County, State of Mississippi in Book 744 at Page 346; and
 
WHEREAS, said Deed of Trust was subsequently assigned to Wilmington Savings Fund Society, FSB, as trustee for Stanwich Mortgage Loan Trust A by instrument dated May 17, 2016 and recorded in Book 1060 at Page 567 of the aforesaid Chancery Clerk's office; and
 
WHEREAS, Wilmington Savings Fund Society, FSB, as trustee for Stanwich Mortgage Loan Trust A has heretofore substituted Shapiro & Massey, LLC as Trustee by instrument dated July 26, 2016 and recorded in the aforesaid Chancery Clerk's Office in Book 1066 at Page 351; and

SUBSTITUTE TRUSTEE'S NOTICE OF SALE
      WHEREAS, on June 16, 2014, Michael Mabry and Kasey J. Mabry, Husband and Wife, executed a Deed of Trust to Marshall H. Smith, Jr., Trustee for the use and benefit of Holmes County Bank & Trust Company, which said Deed of Trust is on file and of record in the office of the Chancery Clerk of Attala County, Mississippi, in Deed of Trust Book 1016 at Page 282 thereof; and
      WHEREAS, the legal holder of the said Deed of Trust and the note secured thereby, substituted John M. Gilmore, as Trustee therein, as authorized by the terms thereof, by instrument recorded in the office of the aforesaid Chancery Clerk in Trust Deed Book 1064 at Page 473 thereof; and
      WHEREAS, default having been made in the performance of the conditions and stipulations as set forth by said Deed of Trust, and having been requested by the legal holder of the indebtedness secured and described by said Deed of Trust so to do, notice is hereby given that I, John M. Holmes Map and Plat of the Town of Sallis, which is on file in the office of the Chancery Clerk of said Attala County, Mississippi.  Less part East of ditch sold to Lutheran Church.  The lots mentioned herein are the lots as they existed on June 6, 1958, and this is the same property as conveyed to Lena Porter in Land Deed Book 184, Page 219 thereof, reference to which is hereby specially made.
 
TRACT II:
Beginning at the SE corner of Lot # 88 of the W. E. Holmes Map and Plat of Sallis, Mississippi, dated 3-31-1931, thence run North 2 degrees 34 feet West 213 feet to a point on the Southerly R.O.W. of Lloyd Street, thence run South 89 degrees 19 feet West 5.0 feet to a point, thence run South 2 degrees 34 feet East 213 feet to a point, thence run East 5.0 feet to the Point of Beginning.  This lot or parcel of land is located in Lot # 88 according to the above described Map and Plat prepared by W. E. Holmes of the Town of Sallis, Mississippi, which Map is on file in the office of the Chancery Clerk of Attala County, Mississippi.  This strip of land contains a total of 0.02 acres, more or less.
 
     Title to the above described property is believed to be good, but I will convey only such title as is vested in me as Substitute Trustee.
