SUBSTITUTE TRUSTEE'S NOTICE OF SALE
      WHEREAS, on June 16, 2014, Michael Mabry and Kasey J. Mabry, Husband and Wife, executed a Deed of Trust to Marshall H. Smith, Jr., Trustee for the use and benefit of Holmes County Bank & Trust Company, which said Deed of Trust is on file and of record in the office of the Chancery Clerk of Attala County, Mississippi, in Deed of Trust Book 1016 at Page 282 thereof; and
      WHEREAS, the legal holder of the said Deed of Trust and the note secured thereby, substituted John M. Gilmore, as Trustee therein, as authorized by the terms thereof, by instrument recorded in the office of the aforesaid Chancery Clerk in Trust Deed Book 1064 at Page 473 thereof; and
      WHEREAS, default having been made in the performance of the conditions and stipulations as set forth by said Deed of Trust, and having been requested by the legal holder of the indebtedness secured and described by said Deed of Trust so to do, notice is hereby given that I, John M. Gilmore, Substitute Trustee, by virtue of the authority conferred upon me in said Deed of Trust, will offer for sale and will sell at public sale and outcry to the highest and best bidder for cash, during the legal hours (between the hours of 11 o’clock a.m. and 4 o’clock p.m.) at the North door of the Attala County Courthouse, Kosciusko, Mississippi, on the 23rd day of September, 2016, at 11:05 A.M., the following described land and property being the same land and property described in said Deed of Trust, situated in the Town of Sallis, Attala County, State of Mississippi, to‑wit:
      TRACT I:
Commence at the Northwest corner of property now owned by George Miller and formerly known as the F. D. Brown Lot and on the South side of the Kosciusko and Sallis Public Road, also known as Mississippi State Highway No. 429; and run West up the said Kosciusko and Sallis Public Road a distance of 356 feet to the property now owned by W. E. Edwards and to a point 20 feet East of what was formerly known as the M. L. Allen Lot; run thence South along the Eastern boundary of the property of W. E. Edwards a distance of 180 feet to a point 20 feet East of the Southeast corner of what was formerly known as the M. L. Allen Lot; run thence East 356 feet to the property of George Miller, formerly known as the F. D. Brown Lot; run thence North 200 feet to the starting point; said lot of land hereby conveyed being located in Section 35, Township 14 North, Range 5 East, and being part of Lot No. 92 of the W. E. Holmes Map and Plat of the Town of Sallis, which is on file in the office of the Chancery Clerk of said Attala County, Mississippi.  Less part East of ditch sold to Lutheran Church.  The lots mentioned herein are the lots as they existed on June 6, 1958, and this is the same property as conveyed to Lena Porter in Land Deed Book 184, Page 219 thereof, reference to which is hereby specially made.
 
TRACT II:
Beginning at the SE corner of Lot # 88 of the W. E. Holmes Map and Plat of Sallis, Mississippi, dated 3-31-1931, thence run North 2 degrees 34 feet West 213 feet to a point on the Southerly R.O.W. of Lloyd Street, thence run South 89 degrees 19 feet West 5.0 feet to a point, thence run South 2 degrees 34 feet East 213 feet to a point, thence run East 5.0 feet to the Point of Beginning.  This lot or parcel of land is located in Lot # 88 according to the above described Map and Plat prepared by W. E. Holmes of the Town of Sallis, Mississippi, which Map is on file in the office of the Chancery Clerk of Attala County, Mississippi.  This strip of land contains a total of 0.02 acres, more or less.
 
     Title to the above described property is believed to be good, but I will convey only such title as is vested in me as Substitute Trustee.

You are hereby notified that sealed bids to lease the hunting and fishing rights on the above described forest land may be filed in the Attala County Courthouse with the Superintendent of Education, Kosciusko, Mississippi on or before 2:00 p.m. on October 3, 2016 .  The sealed bids must include 10% of the amount bid.  This amount will be refunded if not the highest bid.  The sealed bids submitted will be opened at 5:30 pm at the Attala County regular school board meeting on October 3, 2016  The minimum bid shall be $6.00 per acre, with a minimum lease of three years. The Board reserves the right to reject any and all bids, but if any bid is accepted, the Board will award said hunting and fishing lease to the highest bidder.  All recording cost and advertising cost will be charged to the lessee.

Ordinance Number 657
 
An Ordinance establishing that no person shall be permitted to operate or allow to be operated, an internal combustion engine powered vehicle within the City of Kosciusko while said vehicle or operator is utilizing an engine brake or an exhaust brake without an exhaust muffler sufficient to prevent the creation of excessively loud noises by said vehicle, except when the use of such engine is necessary for the safe operation of the vehicle.  This Ordinance is not intended to prohibit the passage of vehicles equipped with engine or exhaust brakes, but rather limit the use of such equipment under the aforesaid circumstances.
 
BE IT ORDAINED by the Mayor and Board of Aldermen of the City of Kosciusko, MISSISSIPPI, as follows, to-wit:
 
SECTION ONE.  Operation of Engine or Exhaust Brakes Declared a Nuisance.
The Board of Aldermen find that the operation of an engine or exhaust brake on a gasoline powered or diesel powered motor vehicle not equipped with exhaust mufflers, or equipped with defective or modified exhaust mufflers, so as to create excessive noise through the use of said engine or exhaust brake, adversely affects the public health, safety, and welfare of the residents of the City of Kosciusko, and therefore is a nuisance in fact.
 
SECTION TWO.   Use Permitted in Emergency Situations.
This Ordinance shall not apply to emergency driving situations requiring the utilization of an engine or exhaust brake to protect the safety and property of the residents of Kosciusko, other motor vehicle operators, pedestrians, and the operator and passengers of the motor vehicle involved in said emergency situation. 
 
SECTION THREE.   PENALTIES.
Any driver and/or the firm or corporation for whom the driver is employed who shall violate any provisions of this Ordinance, shall, upon conviction thereof, be summoned to pay a fine One Hundred Dollars ($100.00) along with any court costs through Kosciusko Municipal Court.  Every day that a violation of this Ordinance continues shall constitute a separate offense.  
 
SECTION FOUR.   SEVERABILITY.
If any sentence, clause, section or part of this Ordinance is for any reason found to be unconstitutional, illegal, or invalid, such unconstitutionality, illegality, or invalidity shall not affect or impair any of the remaining provisions, sentences, clauses, sections or parts of the Ordinance.  It is hereby declared as the intent of the Board of Aldermen that this Ordinance would have been adopted had such unconstitutional, illegal or invalid sentence, clause, section or part thereof not been included therein.  
 
SECTION FIVE.   EFFECTIVE DATE.
This ordinance shall be in full force and effect one month from and after its passage.
 
SO ORDAINED, ENACTED, AND PASSED by the Mayor and Board of Aldermen of the City of Kosciusko, Mississippi, on this the 6th day of September, 2016.
