AN ORDINANCE AMENDING ORDINANCE NO. 469 ENTITLED "AN ORDINANCE TO REGULATE AND RESTRICT THE LOCATION AND USE OF BUILDINGS, STRUCTURES, AND LAND FOR TRADE, INDUSTRY, RESIDENCE, OR OTHER PURPOSES, THE HEIGHT, NUMBER OF STORIES, AND SIZE OF BUILDINGS AND OTHER STRUCTURES, THE SIZE OF YARDS AND OTHER OPEN SPACES, OFF-STREET PARKING AND LOADING, AND THE DENSITY OF POPULATION; AND FOR SAID PURPOSES TO DIVIDE THE MUNICIPALITY INTO DISTRICTS OF SUCH NUMBER, SHAPE, AND AREA AS MAY BE DEEMED BEST SUITED TO CARRY OUT THESE REGULATIONS; TO PRESCRIBE PENALTIES FOR THE VIOLATION OF ITS PROVISIONS AND TO PROVIDE FOR ITS ENFORCEMENT," BY ZONING CERTAIN PROPERTY OF RYAN LINDSAY
 
BE IT ORDAINED by the Mayor and Board of Aldermen of the City of Kosciusko, Attala County, Mississippi, in regular meeting on this the 19th day of August, 2016, as follows, to-wit:
SECTION 1.  That Ordinance No. 469 of the City of Kosciusko entitled "An Ordinance Dividing the City of Kosciusko, Mississippi, into Zones or Districts and Prescribing the Use of Land and Buildings, the Height of Buildings, the Amount of Open Space Adjacent to Buildings, and the Density and Population within each of these Zones or Districts and Prescribing the Penalties for the Violation of this Ordinance, and Other Purposes," which said Ordinance No. 469 was adopted by this Board on April 4, 1995, and appears in Minute Book 27, Page 106, and in Ordinance Book 3, Page 202, be and the same is hereby amended as follows, to-wit:
 
(a) Change the zone from R-1 TO GC-2 on the following described property of Ryan Lindsay, to-wit:
A certain parcel of land situated in the West 1/2 of the Northwest 1/4 of Section 22, Township 14 North, Range 7 East, Kosciusko, Attala County, Mississippi, being more particularly described as follows:
 
Beginning at a 1" iron pipe found marking the Northwest corner of Lot 14, Block C, Highland Park Subdivision, a subdivision on file and of record in Plat Book 3, Page 2 in the office of the Chancery Clerk of the aforesaid Attala County, said point also being on the South right of way line of East Jefferson Street; thence North 60 degrees 41 minutes 49 seconds East along the said South right of way line of East Jefferson Street, for a distance of 253.01 feet to a 1/2" iron pin set on the Western right of way line of Mississippi State Highway No. 35; thence South 81 degrees 12 minutes 51 seconds East along said Western right of way line of Highway 35 for a distance of 227.67 feet to a ½” iron pin set on a 2.06667 degree curve, bearing to the right and having a central angle of 3 degrees 33 minutes 38 seconds and a radius of 2799.49 feet; thence run Southeasterly along the arc of said curve for an arc distance of 173.97 feet (chord bearing and distance South 51 degrees 40 minutes 12 seconds East 173.94 feet) to a 1" pipe found on the North line of Lot 10, Block C of the aforementioned Highland Park Subdivision; thence North 80 degrees 50 minutes 56 seconds West along the North line of Highland Park Subdivision for a distance of 136.05 feet to a 1" iron pipe found; thence South 89 degrees 38 minutes 22 seconds West along the said North line of Highland Park Subdivision for a distance of 447.77 feet to the POINT OF BEGINNING, containing 0.987 acres, more or less.
 
The above property is the same property as conveyed to Lindsay Properties, LLC, by Larry D. Caraway by that certain Warranty Deed dated July 8, 2016, recorded in Attala County, Mississippi, Land Deed Book 823, at page 55 thereof.
 
(b) Change the official zoning map of the City of Kosciusko, Mississippi accordingly.
SECTION 2. This ordinance shall become effective one month after its passage, and the Mayor and City Clerk are hereby authorized to certify a copy of this ordinance and to record same in the Ordinance Book; to publish same one time in The Star Herald, a newspaper published in this municipality; and to revise the official zoning map of the City of Kosciusko, Mississippi, in accordance with this ordinance.
