Murder trial won’t be heard in Feb.

KOSCIUSKO — The murder trial of Theodus Barnett will not be heard on February 4, according to the Attala County Circuit Clerk’s office. A new trial date has not been confirmed.

Barnett, who remains behind bars, was charged in February 2011 for the murder of Kosciusko used auto dealer Danny Tavares and was  transported from Shelby County, Tenn., to Attala County in August.  Barnett was being held on charges in Tennessee.

Tavares, 52, was found dead on May 25, 2007, at his used car dealership, Tavares Motors, on Highway 12.  He was robbed, beaten to death and suffocated.

Barnett’s arrest stemmed from evidence collected at Tavares Motors, where the murder occurred.

A hearing was held in December where several motions were filed by Attala County public defender Rosalind Jordan. She is being assisted by attorney Richard Carter, who is also a county public defender.

A hearing was held on Tuesday for motions to be further discussed.
